1. Overview
This website, www.oxfordum.com, is operated by Oxfordum, based in Kitchener, Ontario, Canada ("Oxfordum", "we", "us" or "our"). These Terms of Service ("Terms") apply to everyone who visits the site or buys from us. By using the site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the site.
Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to offer our products to you.
2. Eligibility
You must be at least the age of majority in your province, state or country of residence to place an order, or have the consent of a parent or guardian. You agree not to use the site for any unlawful purpose.
3. Our Products
Oxfordum is a curated boutique. Many of our pieces are designed, made and shipped directly by independent designers and makers we partner with through Shopify Collective. Product details such as materials, plating, stone type, dimensions and care instructions are listed on each product page based on information provided by the maker.
We make every effort to display colours and details accurately, but screens vary and handcrafted pieces may differ slightly from the photos. Personalized and made-to-order items are produced to the details you provide, so please check spelling, sizes and options carefully before ordering.
4. Prices and Payment
All prices are shown in US dollars (USD) unless stated otherwise. Applicable taxes and shipping charges are calculated at checkout. Prices, promotions and availability may change without notice.
If a product is listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel any orders placed for that product, even after the order has been confirmed. If your payment has already been taken, we will refund it in full.
Payment is processed securely by our payment providers. By submitting an order, you confirm that you are authorized to use the payment method provided.
5. Orders
Your order is an offer to buy. We may accept or decline any order, limit quantities, or cancel orders that appear fraudulent, are placed by resellers, or that we cannot fulfil. If we cancel your order after payment, we will issue a full refund to your original payment method.
6. Shipping and Delivery
We ship to addresses in the United States and Canada. Orders to Canada may be subject to customs duties or brokerage fees on delivery, which are the customer's responsibility. Because pieces may ship directly from different makers, an order may arrive in more than one package. Estimated processing and delivery times are set out in our Shipping Policy and are estimates, not guarantees.
7. Returns and Refunds
Returns, exchanges and refunds are governed by our Refund Policy. Personalized and custom pieces and items marked Final Sale cannot be returned unless they arrive defective, damaged or incorrect.
8. Discounts and Promotions
Discount codes are subject to the conditions stated with each offer, have no cash value, cannot be exchanged for cash, and unless stated otherwise cannot be combined with other offers. We may end or change a promotion at any time, and may cancel orders that misuse a promotion.
9. Accounts
If you create an account, you are responsible for keeping your login details secure and for all activity under your account. Please provide accurate, current information and keep it up to date.
10. Intellectual Property
All content on this site, including text, graphics, logos, photographs and the Oxfordum name, belongs to Oxfordum or our makers and licensors and is protected by intellectual property laws. You may not copy, reproduce, republish or commercially use any content without our written permission.
11. Reviews and Submissions
If you submit reviews, comments, photos or other content, you confirm that it is your own, is accurate, and does not infringe anyone's rights or contain unlawful, offensive or misleading material. You grant us a non-exclusive, royalty-free licence to use, display and edit that content in connection with our store. We may remove any content at our discretion.
12. Prohibited Uses
You may not use the site to break any law; to infringe our rights or the rights of others; to submit false or misleading information; to upload viruses or malicious code; to collect other people's personal information; to scrape, spider or crawl the site; or to interfere with its security or operation.
13. Third-Party Links and Services
The site may link to or use third-party services, such as payment providers and shipment tracking. We are not responsible for third-party websites or services, and your use of them is subject to their own terms and policies.
14. Disclaimer
Except as expressly stated in these Terms or as required by law, the site and its content are provided "as is" and "as available". We do not guarantee that the site will be uninterrupted or error-free.
15. Limitation of Liability
To the fullest extent permitted by law, Oxfordum will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or any product purchased through it. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits any rights you have under consumer protection laws that cannot be excluded or limited.
16. Indemnification
You agree to indemnify and hold harmless Oxfordum and our partners from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute will be subject to the courts of Ontario, except where the law of your place of residence gives you the right to bring a claim in your local courts or provides consumer protections that cannot be waived.
18. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and applies to orders placed after that date.
